Abstract

Four daughters of the late William Washington seek to recover money and assets of his estate. The petitioners explain that their brother William bought thirty-six estate slaves, a "great portion of the Estate." He gave a secured bond and mortgaged the slaves back to the administrator, but he never paid for the slaves in full. Later, he mortgaged various slaves multiple times to multiple people. When the administrator, Josiah Taylor, tried to reclaim and resell the slaves, his agents could not obtain all of them. John Stock, another of their brother's creditors, had already sold ten of them to recover his money. Several people, who bought slaves at the foreclosure sale, have not paid, and the Bank of the State of South Carolina claims part of the money for its claims against William Washington. Taylor sued the various parties involved, as his mortgage had prior claim, but he died before he regained the assets. His executrix holds some securities that belong to Washington's estate. The petitioners ask that the court order the parties involved to return the money and securities to the elder Washington's estate for division among the heirs.
