Abstract

Mary Nix seeks "a reasonable support" from her abusive husband, B. W. Nix. She states that her husband "has become intollerably abusive" and "has not only repeatedly threatened her Life but on several occasions inflicted actual violence on her person by whipping." Nix cites that on one occasion she "shut up the house and went to see a sick neighbour near by directing the cook woman ... to send after her as she had the keys as it was the custom to take the keys when no white person was at home." She confesses that upon her return her said husband "with a Large overseers whip commenced whipping her with great violence when she attempted to make her escape out of the house he started to get his gun as was his habit, she however, made good her escape." Mary notes that she "is entitled to a small interest" in the estates of her late parents, Henry and Margaret Dominick. She therefore prays that said interest be "settled to her sole and separate use and benefit" and that "she be allowed a reasonable support by way of alimony." Nix also asks that her husband's "appointment of guardianship" for one of her infant daughters "be revoked and another appointed."
