Abstract

Pendleton and Jennett King seek to recover a sixteen-year-old slave named Fanny. The petitioners remind the court that they filed a bill in 1836 "against John Paysinger, who was the guardian of the said Jennett," and they report that the court ordered "that the funds in the hand of the said Paysinger be settled to the sole and separate use of the said Jennett King." They state that they filed another bill in 1841 "praying that the funds in the hands of the said John Paysinger should be invested in the purchase of a negro girl to be settled on your Oratrix, according to the terms of the aforesaid decretal Order." The Kings submit that said John had purchased "a negro girl slave ... and had taken titles for her as Trustee of the said Jennett King" in 1842 and that "he had delivered the said negro girl to the said Jennett King." Noting that John Paysinger died in 1845 and that his brother Benjamin "was appointed his Executor," they charge that "soon after the said Benjamin Paysinger ... entered upon the duties of his office, as executor, he wrongfully and forcibly took the said negro girl slave out of the possession of your Oratrix." The Kings contend that said slave is a "family servant, and in that capacity is of peculiar value to your Oratrix." They therefore pray that Benjamin Paysinger be compelled "to deliver the said slave into your Oratrix possession, and to account for the hire" and that she "may be quieted in the possession of said slave."
