Abstract

William and Mary Caldwell ask that Mary's trustee be permitted to purchase a 16-year-old slave named Jesse with funds from her trust estate. The petitioners represent that Mary received her distributive share of her father's estate in 1848, wherein the court ordered that said share "be settled in trust to her sole, and seperate use, and benefit during her natural life" and appointed her brother, John Y. Chandler, to serve as her trustee. The Caldwells report that they requested the said Chandler "to purchase for them, to be taken as part of their share, a negro Boy named Jesse" and that "he was accordingly bid off to them" at $650. Believing said "purchase to be a prudent one," the petitioners "desire that it may be confirmed by the order, and decree of this Honorable Court." They therefore pray that "John Y. Chandler Trustee ... be ordered to pay the purchase money for said slave out of the trust fund before mentioned, and that the title to said slave be vested in him upon the same trusts and limitations, as the Trust fund aforesaid."
