Abstract

The family of Kimbro DuBose asks that James H. DuBose "be appointed trustee ... & substituted in the place and stead of the Said Boykin & John Witherspoon." The petitioners represent that John N. Williams conveyed thirty slaves, "of the value of nine Thousand Dollars," in 1843 in trust to the Witherspoons "for the use and Support of the Said Kimbro C, his Said wife and children" during their joint lifetimes. They inform the court, however, that they own no land and "being unable on advantageous terms to procure a good plantation upon which to operate with Said slaves, the nett proceeds arising from the Labor of Said slaves have not been much more than Sufficient to defray the expenses of the Family of Said Kimbro C." The DuBoses reveal that they intend to move the family, and the slaves, to Alabama, where they "expect for the future permanently to reside." They report, however, that the current trustees "are unwilling that the Said slaves shall be So removed unless Some Suitable and proper person was first appointed ... as Trustee" in their place. The petitioners therefore pray that James H. DuBose be appointed said trustee.
