Abstract

Thomas B. Wadlington seeks a partition of his late mother's slaves. Nancy Wadlington's father, Thomas Banskett, gave her a life estate in a slave named Lodusky in 1831. At his death, Banskett gave Wadlington seven more slaves and land. The petitioner notes that his mother "exchanged the slave Eve with her brother for a slave named Sam-- the slaves being both quite old and of little or no value, and the exchange being made from motives of humanity to enable the slaves to be with their families." Two of the other slaves devised to Nancy have since died. Thomas reports that his mother died in 1848, leaving him and his minor sister, Caroline J. Wadlington, as her sole heirs. The petitioner "is desirous that the said land and the said slaves ... may be partitioned and divided between himself and his said sister." Therefore, he prays that the court order such a partition and that it also appoint a guardian to defend his sister's interests.
