Abstract

The children of the late Catharine Folk and the late Rebecca Landley, "being of full age," represent that they "are desirous to obtain their respective shares of said lots of slaves in which they are respectively interested." The petition reveals that an unnamed testator devised his slaves to his three daughters, all of whom are deceased. The petitioners state that "your orators who are executors of said will desire to obtain the directions of this Court as to the disposition which they ought to make of the three lots of slaves which have been set apart for the children of their testators three deceased daughters." They therefore pray that the minor children of the said deceased daughters may be made party defendants and that the court may "order the said three lots of slaves to be subdivided among the persons interested therein according to their respective rights, or order the same to be sold for partition."
