Abstract

Theodore S. Wilson asks that Hardy Stuckey be required to "retake into his possession" a certain "negro Boy Gilbert." Wilson informs the court that he agreed to sell "two negro slaves, to wit, Sue & her child Amelia" to Hardy Stuckey for $800 in January 1851. He further reports that he amended his offer in March to include two more slave women named Hester and Eliza, whom he agreed to exchange "for a young & active negro boy," along with $1,350 "as the difference in the values of the said negroes." The petitioner states that "the said exchange was made" and that Stuckey paid him $500, took possession of the four female slaves, and delivered Gilbert to him. Charging that "the said negro Boy Gilbert is completely idiotic, & utterly useless," Wilson contends that the defendant "has knowingly & wilfully imposed upon your Orator worthless property." The petitioner therefore prays that Stuckey "be compelled to retake possession of the said negro Boy Gilbert" and that he "be decreed to speciffically to deliver up to your Orator the said slaves Sue Amelia Hester & Eliza, & to account to your orator for their hire."
