Abstract

George Long, the widower of Susannah Kibler, asks that the slaves in her estate be divided between him and his son, John William Long. Long informs the court that, in 1834, John Countz "devised to his niece Susannah Kibler and her heirs forever" five slaves and one half of a tract of land; however, the said Susannah "was not to have possession of the said negroes till the death of his wife, to whom the said estate both real & personal was bequeathed & devised during her natural life." He further reports that the testator died in 1838 and that Mary M. Countz died in November 1849 "after the death of the said Susannah his wife." The petitioner reveals that the said slaves now number seventeen and that he has received the said slaves "in his own right & as guardian of his son John William Long." He asserts "that the said land & negroes remain to be partitioned between himself and his son John William Long in the proportion of one third to himself and two thirds to his said son." Long therefore prays that a writ of partition may be directed to certain persons, "authorizing them to make partition of both the real & personal estate between the plaintiff and his son."
