Abstract

The heirs of Sarah Godbold request the partition and division of her estate. Thomas Godbold executed his last will and testament in 1825. He died shortly thereafter survived by his widow Sarah and six children, one of whom has since died. The executors settled the estate to the satisfaction of all parties. Sarah was given a life interest in certain property, including a group of four slaves and lands. Sarah died in 1853 intestate and the distribution of her estate is now being contested. Thomas's will directs that, upon Sarah’s death, his property was to be "divided amongst his (testators) surviving heirs share and share alike." Sarah's estate includes twelve slaves and land; this tract of land, owned by Thomas, was never sold as dictated by his will. The defendants are the heirs of Elizabeth Godbold, the late daughter of Sarah and Thomas, and they assert they have an interest in Sarah's estate. The lineal heirs of Sarah are requesting an immediate partition and division of the estate, to which Elizabeth's heirs refuse. Therefore, the heirs of Sarah Godbold seek the partition and distribution of Sarah's estate as well as an accounting of the defendants' actions.
