Abstract

Eleanor Martin seeks to recover a female slave named Rosanna. She states that her father, Jared Young, executed his will in 1839, whereby he directed that "the residue of my property be equally divided among my children share and share alike." Eleanor avers that her said share included "a certain negro girl slave named Rosanna." She also notes that she later became indebted to her brother, Thomas Young, and that she secured said debt by placing Rosanna "in his hands." She states that Thomas, before his death in 1853, gave Rosanna to Charles Young and that Rosanna "by him has been sold and delivered to James Fant." The petitioner therefore prays that Fant be restrained from removing Rosanna "beyond the jurisdiction of this Court" and that he "may be decreed ... to deliver up the said slave to your oratrix or to account for her value." The decree cites that Jared Young, in consideration of "natural love & affection to his daughter," gave "a certain negro woman Clarissa & her child Rachel" to Eleanor in 1834. It reveals that Clarissa "was tried in 1838 ... for killing her child Rachel & it seems was sentenced to be removed from the State & sold."
