Abstract

Ephraim Suber and Christian Suber, executors of the late David Suber, seek an order for the sale of three slaves. The petitioners represent that their brother executed his will in 1837, whereby he bequeathed unto certain slaves their freedom. The Subers "are advised that the bequests of freedom and the legacies and devises to said slaves ... are contrary to the Statute law of this State and void." They further report that "said slaves remain for partition amongst said testator's next of kin" and that the testator "made no disposition in his said last will and testament" of several tracts of land. The petitioners therefore "submit this construction of said provisions of said will to the adjudication of this Honorable Court, and pray that an order may be granted by your Honors for the sale of said slaves Lark, Prissly and Edy." They also request that "said four tracts of land may be partitioned amongst the said heirs at law."
