Abstract

Nancy Caroline Dewalt Mayer joins her husband, Orlando B. Mayer, in asking that her brother and trustee, George G. Dewalt, be "authorized to deliver over to the said Orlando B Mayer and his wife all the negroes and increase to which the plaintiff may be entitled under the ... will" of her late father, David Dewalt. The Mayers report that David Dewalt died in 1834 and that his will directed that "all the negroes of the said testator ... was to be divided into as many lots as he might have children then living." They further aver that it was decreed that twelve slaves, "comprising Lot No 2," be "vested in the said George G Dewalt, in Trust for the sole and separate use of Nancy Caroline Dewalt during her life." Married in 1851, they avow that they have incurred expenses in erecting "a neat and commodious dwelling house" and in "procuring furniture and such other necessary articles for housekeeping as are suitable for the station of the plaintiffs in life." The Mayers also submit that it is Nancy Caroline's express desire that said slaves "be delivered over to her husband, to aid him in supporting and maintaining the plaintiff." The petitioners therefore pray that the defendant be allowed to relinquish the said slaves and their hire to the said Orlando "to be used by him in defraying the necessary family expenses, or investing the same in property, either personal or real."
