Abstract

John A. Moore, executor for the estate of the late Pleasant Lowe, seeks to pay Lowe's debts. Lowe died in 1850 leaving a mercantile business," which he ran with William W. Lowe, and fifteen slaves, whom he distributed to James Lowe and other heirs. Moore asserts that, "the individual indebtedness of the said Pleasant Lowe is not large but he has been informed that there still exists a considerable amount of indebtedness of the said firm of P. & W. W. Lowe which the said W. W. Lowe has not paid and satisfied." William Lowe is now partners with B. G. Lowe, and they have "been carrying on business with" goods purchased from the original company. However, William "has become very dissipated and has neglected his business," leaving him insolvent; therefore, Moore cannot pay his testator's debts with the company's assets. In addition, James Lowe has sold three of the estate slaves and "is endeavoring to sell" others, an act that would further hinder Moore's ability to settle the estate. Moore therefore prays that the company's creditors be compelled to account for their claims; that William Lowe be ordered to pay these debts; and that James Lowe be enjoined from selling any of the remaining slaves until the estate is fully settled.
