Elizabeth and John H. Moody seek a distribution of her late brother's estate. Matthew Mace died intestate in 1853 possessed of 1400 acres of land and twenty-nine slaves, leaving as heirs his siblings and their families. Moody qualified as administrator of the estate and has sold all the property except the slaves. The petitioners now wish to divide the remainder of the property among the distributees, but said heirs refuse to comply. Therefore, the petitioners pray that the court order a partition of the remaining property in the estate; that Moody be allowed to account for his administration of the estate; and that he then be discharged of the duty. The related distribution report includes assessed values for all the slave property.
