Abstract

Samuel Martin, trustee of Rebecca Frances Martin O'Neale, seeks to protect his sister's trust estate of five slaves. In 1848, Robert Martin conveyed a slave named Ellen and her child Caroline in trust to Samuel "for the sole use benefit and behoof of my said daughter Rebecca Frances O'Neale" and her children. Since 1848, Ellen has had three more children, "whose names are unknown to your Orator." Martin now reports that his brother-in-law, "Godfrey O'Neale is improvident and thriftless in his habits, and, as your Orator believes, much involved in debt; that he has ill-treated and misused his said wife, and your Orator has been informed and does verily believe, that the said Godfrey O'Neale has threatened to remove said negroes out of the jurisdiction of this Court, to wit, to the state of Florida." In order to preserve the trust estate, Martin has demanded possession of the slaves, who are now worth about $2000, but O'Neale has refused to surrender them. The petitioner now prays that O'Neale be "restrained by the injunction of this Honorable Court" from removing the slaves from the state and "from interfering with the possession thereof by your Orator in any manner whatsoever."
