Abstract

John T. Kinney seeks a distribution of his late father's estate. William Kinney died intestate in 1851 possessed of considerable land and slaves. Kinney's widow, Fereba Kinney, has been named administratrix to the estate, and the petitioner is informed that she is about to sell an estate slave named Jack in order “to pay all the debts and liabilities of the estate." Once the debts are paid, the petitioner is "desirous of holding and enjoying his share of the real and personal estate of his father." Asserting that the widow and the other heirs do not wish to distribute the estate, Kinney prays that the court order an account to be taken of the estate property and that commissioners be appointed to divide the estate, thereby enabling him to acquire his share of the property.
