Mary Anne McIntosh, administratrix of her late husband's estate, seeks a distribution of his property. Benjamin C. Lampley died intestate in 1848, possessed of thirteen slaves and leaving only the petitioner and their infant son, also named Benjamin C. Lampley, as heirs. The petitioner has since married Nicholas McIntosh, who joins her in this petition. They therefore "desire to account for your Oratrix, Mary A. McIntosh's administration of the estate of said Intestate and that your Orator & oratrix may have their share of said Estate allotted to Them in severalty." The decree reveals that commissioners assigned five of the slaves in trust to the petitioner and her husband "for the joint use and benefit of the Complainants during the marriage and afterwards, for the use and benefit of the survivor during his or her life."
