Abstract

Eleanor Young Martin, the daughter of the late Jared Young, seeks to recover "a family servant" named Affy, who was given to her by her father in 1839. The petitioner represents that her father conveyed 5- or 6-year-old Affy "together with all the profits and increase of the same" to her brother, Christopher Young, "in trust for the use, benefit and behoof of your Oratrix and the heirs of her body forever." Martin informs the court that "Affy went into the possession of your Oratrix and so continued until ... she came unlawfully into the possession of one Jesse L Jeter." The petitioner charges that Jeter has "unjustly detained" Affy and "has uniformly refused, under various pretences" to deliver her up, "although he well knew her to be the property of your Oratrix." The petitioner prays that Jeter be summoned to answer her charges and that, among other things, he "be required to account for her hire while in his possession and deliver her, with her hire, to your Oratrix."
