Abstract

Malcolm McRae and Margaret Jane McLucas McRae request an accounting of and payment for the profits accrued from a slave's hire. John McLucas, father of Margaret, died intestate. Shortly after his death a "partition was made of his estate; Margaret received 309 acres of land, money, and a slave named Reuben. In 1844 John C. Sinclair "procured letters of guardianship of the person & property" of Margaret, and the petitioners assert that he "Executed a Bond ... for the Faithful discharge of the duties." Margaret married Malcolm McRae in 1852, and the land and slaves held in trust for Margaret were transferred to the couple in 1853. However, Sinclair died before he made an account of his "actings & doings.” Erasmus Weatherly obtained "Letters of Administration upon all & singular ... goods & chattels" belonging to the estate of John Sinclair. The petitioners have repeatedly asked Weatherly to make an account of the "moneys received by the said Sinclair as Guardian" but to no avail. Therefore, the petitioners ask the court for account of all rents and profits gained by the lands and slave held in Margaret's trust estate from 1844-1853. They further request payment once the amounts are specified.
