Abstract

John P. Kinard, trustee of the Lake children, asks the court’s permission to sell trust property for the payment of debts. In 1845 Kinard was appointed trustee for the estate of Lettuce Lake. The petitioner faithfully executed his duties through the maintenance of land and the purchase of property, including three slaves. In 1855 both Lettuce Lake and her husband died; the Lakes are survived by two children, Elizabeth and Middleton. Having "had to employ a person to take care of the said children and negroes," Kinard asserts that this and other financial burdens have put the trust estate in debt. The petitioner maintains that some of the trust property has greatly increased in value and that it would be in the best interest of Elizabeth and Middleton to sell the property. Therefore, the petitioner requests that he be allowed to sell a portion of the trust estate.
