Abstract

Joel McDaniel asks to be appointed the trustee of his fifty-year-old brother, Thomas McDaniel. Confiding that Thomas was born "deaf and dumb," the petitioner states that the "said Thomas was wholly incompetent from weakness and imbecility of mind to manage" the "small legacy ... left him in his father's will consisting of a negro and a small amount of money." Joel asserts that "the property under his management has increased considerably, the negro property to eight and the money to some twelve or fifteen hundred dollars." Noting that Thomas has no land on which to work the slaves, the petitioner purports that it would be to his brother's "interest that said property ... be sold and the money put at interest." He therefore prays "that he may be appointed said trustee."
