Abstract

Maria Eggart Wall, a free woman of color, requests the partition or sale of land. She informs the court that her mother, Juliet Eggart, died and bequeathed a lot of land and "a negro girl Celia, also household and Kitchen furniture" to her three children: the said Maria and her sister Harriet and brother Michael. The testatrix stipulated that said property was "to be equally divided between them and their heirs share and share alike when her son Michael Eggart should attain the age of twenty one years." Gilbert C. Geddes, "who never qualified on the said will" as executor, nonetheless "sold the girl Celia." The remainder of said estate property "has been enjoyed in common by your Oratrix and her brother and sister ever since." Wall now asserts, however, that "the time when partition may take place [has] arrived." She therefore prays that a writ of partition may issue from the court for the division or sale of said land.
