Abstract

Rose Ann McLauchlin requests the appointment of a trustee and an account of the defendants’ actions. Rose Ann represents that she conveyed 200 acres of land, nine slaves, livestock, and several other items to Philip E. Crosland in 1849. She submits that the two parties agreed that said property was to be held by "a fit & proper trustee" for Matilda Crosland, sister of Rose Ann and wife of Philip. The arrangement further stipulated that the petitioner would receive life maintenance from profits earned by the estate. However, Philip has "failed to convey the said property to a suitable Trustee" and has even offered parts of the estate for sale as if it were his own. Therefore, the petitioner requests that the estate be transferred to a responsible trustee, that the defendants be ordered to account for their actions, and that she be granted an annual support taken from the estate’s profits.
