Petition #21385661

Abstract

The petitioners request an accounting for and delivery of slaves. In 1819 Isham Kendrick died intestate. His widow Elizabeth administered over the estate and sold his property at auction. At said sale, Elizabeth purchased "Seven or Eight negroes & other property ... without paying for it or accounting" to the heirs until 1827, when the "children called for their Share" of the slaves and Kendrick's estate. Elizabeth, unable to pay, "gave up all the negroes for partition among the children;" however, Elizabeth did petition for permission to purchase a slave woman named Amadine. Amadine and her increase were to remain in Elizabeth's possession for life and "at her death to be divided Equally among her children." The petitioners state that Elizabeth lived with her daughter Polly and that the two of them sold Amadine's children and grandchildren to various individuals before Elizabeth died in 1853. With the slaves now "scattered abroad to places unknown to the complainants," the petitioners pray that the defendants be compelled to give an account of said slaves and that the court "may order the sale said of said negroes."

Result: Dismissed.
