Abstract

Hosea Vise seeks his portion of his late father's estate. He reports that his said father, Nathaniel, died intestate in 1850. Andrew Pettet, as administrator, settled the estate and petitioned the court to make an accounting of said estate. The petitioner asserts that he did not hear of said court appearance until a few days prior to said hearing. He therefore appointed an "attorney to receive his share" of the estate; however, instead of "decreeing anything in his favor on settlement the ordinary admitted demands in the way of advancements against your orator" amounting to $940. Vise contends that he was "erroneously and fraudulently charged" for land and a female slave, valued at $500. The petitioner denies that his father ever gave him any advancements of land. He further asserts that he in fact paid for the said slave and that he can account for any other transactions linked with his father. Hosea asks the court to dismiss any advancements assigned to him. He further requests that the other heirs fully account for their actions and that they pay him a portion of the estate’s money plus interest.

Result: Dismissed.
