Abstract

James M. Rutland and Charnal D. Ford, executors of Nicholas A. Peay's will, request the court's assistance to satisfy debts. Nicholas A. Peay "died seized and possessed of real and personal estate of great value, encumbered however by sundry debts." Peay's estate included several "tracts of land" and accrued interest in a gold mine. In addition, Peay possessed two house servants, Francis and Charlotte. Peay's children, all minors, do not "have any peculiar attachment for said two slaves, [nor] are [they] unwilling that they should be sold." Therefore, the petitioners request the sale of land, slaves, and interest in said mine. They seek "to apply the proceeds of said sales to the satisfaction of the more pressing of Testator's judgment creditors."
