Abstract

The creditors of George Neal request the settlement of a debt. They inform the court that the said Neal owes several families, particularly the estate of Charles Floyd, large sums of money. Although a deed of assignment was filed in court, neither Neal nor his assignees have paid the money owed. In fact, Neal has "voluntarily and without consideration, conveyed, gave off, and advanced to his children or for their benefit certain of his property;" these gifts include several tracts of land and five slaves. The petitioners contend that this property should have been used to satisfy Neal's outstanding debts. They therefore ask that Neal be ordered "to pay off and discharge the debts ... and that in case of his neglect or failure to make such payment” that his children and heirs “be ordered and decreed to deliver up all and singular the property and effects so given delivered or advanced to or for the benefit of them."

Result: Granted pro confesso.
