Abstract

Peggy Entzminger seeks the court's assistance to gain possession of the slaves and property bequeathed to her by the will of John Entzminger. She states that the said John died in 1854 and that his will entitled her, "for and during" her natural life, to a tract of land, eleven slaves, and "everything" else in the testator's possession; upon her death, the estate was "to be equally divided between the six children" of Frederick Entzminger, John brother. The said will designated Thomas Entzminger and Dr. Samuel Bookhart as executors, yet they declined, whereupon Frederick Entzminger then qualified as administrator of the estate and thereafter became "seized and possessed of the whole of his [John's] estate real and personal." The petitioner now requests that Frederick "come to an account and settlement ... for the estate" and that he relinquish control of the slaves and property. She also asks that Frederick be enjoined from selling any of the slaves "until further order from this honorable court."
