Abstract

The petitioners seek to prevent the Swedish Iron Manufacturing Company from selling slaves that belong to the life estate of Rebecca A. Taylor Brown. Rebecca Brown’s father, John Taylor established two life estates that collectively included forty-nine slaves for the benefit of his daughter and her heirs. According to the terms of both trusts, William J. Taylor and Thomas T. Brown, as trustees, were authorized to sell, convey, and dispose of trust property as long as the proceeds of these transactions returned to the trust. The petitioners contend that, since 1839, several of the slaves have fallen into the possession of various individuals in South Carolina, including professors at South Carolina College and The Swedish Iron Manufacturing Company of South Carolina. The petitioners have learned that the Swedish Iron Manufacturing Company of South Carolina, which possesses twenty-five of Rebecca Brown’s slaves, has advertised to sell them. Therefore, the petitioners request that the defendants be enjoined from selling said slaves and that they be required to return the slaves “to the issue of said Rebecca A. Brown at the termination of her life estate."
