Abstract

Lucinda Payne Boyd joins her husband, William Boyd, and C. B. Griffin in requesting that the executors of the late John Payne account for the division of said estate. They report that John W. Payne died in 1857, having executed a last will and testament. By said will, Payne bequeathed slaves and their increase, as well as "all [his] Bank Stock of Money," to his widow Lucinda. The petitioners, however, charge that Payne's executors sold many of said slaves, on the grounds that the slaves "did not pass to" Lucinda "under the respective clauses of the will." Lucinda insists that she was entitled to the slaves according to the will and that the sales were "in violation of her rights.” The petitioners therefore pray that they receive compensation from said sales as well as an accounting of the actings and doings of said executors.
