Abstract

Samuel Atkinson, an administrator of the estate of Peter DuBose, requests the partition of his late father-in-law's estate. He and his wife Susannah aver that the said Peter died intestate in 1856 seized of more than 1200 acres of land and a number of slaves. They report that Peter's widow, Amanda DuBose, served as administratrix of his estate between 1856 and 1858, during which time she sold a portion of his personal estate; in 1858 the court revoked her letters of administration and appointed Samuel Atkinson and Ervin H. DuBose the new administrators. The current administrators have since inventoried the estate and purchased six slaves from Amanda DuBose, who claimed exclusive title thereto, for the heirs of Peter DuBose. They also ascertained that several of Peter DuBose's heirs had received advancements on their inheritance, receiving a total of ten slaves. Samuel Atkinson asks that he be permitted to action for his actions as administrator. Furthermore, he requests that the remaining estate be divided among the respective heirs. In a subsequent report, court-appointed commissioners recommended that the bulk of Peter DuBose's property be sold and that the profits be distributed among the respective heirs.
