Abstract

Jane White and her next friend, Robert D. White, seek an injunction to prevent her husband from seizing property in her trust estate. They represent that John White mortgaged fifteen slaves to Phineas Pierce in 1855 for $6815. Later that year, Pearce "by the consent and directions of the said John White conveyed the said Slaves to your Oratrix's son William White in Trust for your Oratrix." Between 1855 and 1859, these slaves remained in trust for Jane's sole and separate use. However, the petitioners charge that in the last month the said John, "without setting up any title to redeem or any right to an account for profits from your Oratrix or her Trustee," has "taken some of the said slaves out of possession of the Trustee and lodged them in Jail ... and threatens to seize the others." In addition, he "pretends at times that the trust is not for the sole and separate use of your Oratrix." The petitioners therefore pray that the trust estate established by John White for Jane's benefit be enforced and that the said John be enjoined from "interfering with the said Slaves without your Oratrix's consent."
