Abstract

Reese Roark seeks an account of the sale of a female slave named Polly. Roark reminds the court that he brought suit against Andrew Etters and Michael Hambright on 4 October 1858 for the recovery of Polly, "a mulatto girl about nineteen years of age," requesting that they be enjoined from selling her. The petitioner informs the court that the said Hambright and Etters, however, "exposed said negro girl to public sale" and that Thomas Pagan purchased Polly for $1000 despite the petitioner's notice that "he had commenced proceedings" for the delivery of said slave. Roark now reports that Pagan "sold said negro to A C Sutton," who has taken "said girl out of the State, sold her for a large & considerable sum of money for two thousand dollars or more." Charging that the defendants "were partners in the whole transaction," the petitioner argues that they "have by their illegal & unlawful acts defeated your orators right to have said negro delivered to him." He therefore prays that the defendants be compelled to answer his charges and be "ordered & decreed to account to your orator for the sum for which said negro was sold."
