Abstract

Elizabeth Kibler seeks the partition of a life estate that includes fifty acres of land and twenty-two slaves. She represents that her mother, Eve Catharine Koon, conveyed five slaves to Henry Koon in 1828 "in trust for herself during her life, and after her death for the separate use of her daughter (your complainant) during her natural life." Noting that her mother "has been dead for many years," the petitioner, "who is now old and infirm and unable to manage said negros to advantage," complains that "the said negros have increased to twenty five in number ... and are still increasing to such an extent that it is difficult for your complainant to support them and herself too." Desirous of "surrendering her life interest" in said slaves, she therefore prays that the court may sanction an immediate partition of twenty-two of said slaves among her eleven children. Kibler also asks that the fifty-acre tract of land be sold and the proceeds therefrom be applied to the discharge of her outstanding debts.
