Abstract

Anderson Jackson of Anson County, North Carolina, asks the court to enforce the provisions of a deed drawn up between him and William D. Williams. Jackson charges that the said Williams, desirous "to make an ample provision for his wife and their children," conveyed eleven slaves and their increase to the petitioner in 1857 in trust for Williams and his wife Julia "during the term of our joint lives." Jackson notes that Williams and his brother Franklin owned six of the slaves mentioned in the 1857 deed as tenants in common, whereby the conveyance of the slaves could only take place after the court sanctioned a partition of said slaves. However, Franklin Williams died in 1859, leaving William Williams the sole owner of the slaves referenced in said deed of trust. Arguing that the matter of partition is no longer an issue, the petitioner prays that William Williams and his guardian, James O. Hale, be compelled to deliver up the slaves intended to be conveyed to him by the 1857 deed and to account for their hires.
