Abstract

William T. Caldwell asks that the court place two slaves in a trust estate for the benefit of his family. In 1861 Judge John Belton O'Neall and Abigail Caldwell attended an estate sale for the benefit of the indebted petitioners. They agreed to purchase 185 acres of land and two slaves at discounted prices from the estate sale, with the understanding that the land and the slaves would be returned to the petitioners. O'Neall has since died without completing this agreed upon transfer. Although the petitioners claim that Abigail Caldwell is eager to return said slaves to the Caldwell family, they remain in O'Neall's estate because his will does not expressly direct his executors to return them to the petitioners. The petitioners ask the court that all of the property Judge O'Neall and Abigail Caldwell purchased from their 1861 estate sale "be conveyed to a suitable trustee for the benefit of William T. Campbell and his family."
