Abstract

James and Lizzie Baldwin ask the court to sanction the sale of several Columbia lots to Christopher Haynsworth. In 1862 widow Frances Edgar bequeathed these lots, her dwelling house, and twelve slaves to her "grand niece," Lizzie Baldwin. The petitioner has a life interest in these lots, and upon her death, her daughter, Frances Edgar Baldwin, will inherit the estate. The petitioners claim that they had resided at the dwelling house on those lots "until said dwelling house was consumed by fire on the 19th February 1865 when Columbia was destroyed by Gen Sherman's Army." Since the fire, the Baldwins have rented a home at great expense. Although they want to construct a new home, the once "handsome estate" bequeathed to the Lizzie is now worthless. Stating that Christopher Haynsworth has offered to purchase some of the lots for $450, they insist that it is in their best interests and the interests of their young daughter to proceed with the sale in order that they can raise the funds to construct a new home. The petitioners ask the court to permit the sale of these lots to the said Haynsworth.
