Burton Underwood seeks permission to sell a fifteen-year-old slave named Adam, who is part of a trust estate created by Underwood in 1855. The petitioner confirms that the deed of conveyance "was not affected to defeat the collecting of existing debt." However, he admits that he is currently indebted to various individuals for services rendered and for 17 acres of land purchased and that "he has no means of paying them except out of the property conveyed by Said deed." Burton and his wife declare that they "are of the opinion, that the proceeds of the sale of one of the slaves conveyed in said deed would be judiciously invested in the payment of the balance of the land." They therefore "pray that your Honor decree the trustee ... to sell one of the slaves."
