Abstract

The two daughters of the late Daniel McCarty contend that they "are entitled to all his estate not before devised to his wife." They point out that McCarty bequeathed "to his wife Margarett one third part of the negroes which he the Testator might be possessed of at the time of his death." In addition, she was to receive one-half of the remainder of his personal property as well as a share of his land. They report that their mother married Richard Stuart after the death of their father, and they have applied, without success, to the Stuarts "to have the part belonging to their said mother allotted to her." The petitioners pray that "your worships will decree that an allottment to their mother may be made agreeable [to] the will of their father" whereby the remainder may be divided equally between them.
