Abstract

In 1794, John Wormeley created a trust estate for the use of his wife and two sons; it included 1,332 acres of land in Frederick County, some land in Lancaster County, and fifty slaves "& their increase." He stipulated that if he had any children in the future he would legally amend the trust in a last will and testament. In 1808, shortly before his death, he published his will, dividing his real and personal estate in Frederick County equally "between his three children." Now the third child, Mary Wormeley Carter, sues her mother and two brothers, claiming that she and her husband were tricked into signing a marriage contract that essentially deprived them of ownership of her share of the property. She and her husband ask "that the said marriage contract may be rescinded and another substituted," that she be assigned her portion of the property, and that "a fair division of the slaves may be made."
