Abstract

Charles Clay and Editha Davies Clay inform the court that in 1808 "Henry L Davies the ancestor of your petitioner Editha departed this life seized and possessed of a very considerable estate both real and personal without making any disposition of the same." The petitioners report that they instituted a suit "to effect a settlement and distribution of the estate" and that the court directed "a division of the said estate" in October 1809. The Clays "conceive themselves aggreived by the said decrees and orders" emanating from that suit. They therefore "ask leave of your honor to appeal to this honourable court."

Result: Appeal granted; judgment affirmed.
