Abstract

James Trotter informs the court that "he Executed his bond to a certain William Fisher" and that "the said bond was given for the purchase of a Negro woman named Phoebe." Trotter reports that the said Phoebe "was represented to be a fine likely negro, and not one word was said about her being in any manner diseased: on the Contrary your Orator states that it was publickly averr'd that the said woman was not only a fine likely woman, but at that time was actually pregnant which induced your Orator to bid, & give more, for her than he otherwise would have done." Charging that Phoebe "was falsely represented at the time of the sale," the petitioner claims that "she was actually afflicted at the time of the Sale with a disease call'd the King's Evil, a disease that commonly resists the power of Medicine & is but seldom cured." He "discovered also that the said woman was not pregnant." Noting that Fisher assigned the said bond to a third party who "instituted Suit on the said bond against your Orator," Trotter prays "that your worships may Injoin the defendants from further proceeding on the Judgment aforesaid."
