Abstract

Neil McCoull "prays that an injunction may Issue to stay all proceedings" on a judgment "rendered against him for near $200" that stemmed from a suit instituted by Austin Tallman, "the acting Executor" of the late William Enroughfty. McCoull claims that he "employed a certain William Enroughfty alias Darby as an Overseer ... for near four years at the price of £50" per year. With only a "a Negro Girl & some furniture" to his name, the petitioner contends that "it was impossible" for the overseer "to live in the manner he did on £50 a year without geting in debt," citing that Enroughfty dressed his family "in imported Articles" and "used Tea Sugar Coffee & Spirits constantly in his House & entertained Company freely." McCoull reveals that Enroughfty, in fact, died indebted to him "in about the sum of Fifty pounds at the least, for which your Orator would have brought suit but was not willing to take the means of support from the Orphan & helpless Children of a man he believed had served him faithfully near four years." McCoull charges that the supposed debt alleged in Tallman's suit was the result of "a mistake" by the court clerk. Therefore, in addition to the requested injunction, the petitioner asks that the "Account between the said Executor and your Orator may be laid before one of the Commissioners of your Worshipfull Court for a final adjustment."
