Abstract

John Tayloe explains that in the previous year he "purchasd of a certain William Willis ... Two negro Slaves named Moses, and Rebecka, and agreed to give therefor the sum of Nine Hundred and fifty Dollars," for which sum he executed his bond. Tayloe cites "that at the time of the purchase the said Willis represented said slaves to be sound." He informs the court that shortly thereafter "he sold them to a certain Hezekiah Hendrick who after he had kept them a short time returnd them to your Orator alledging they were unsound and diseasd." The petitioner proceeded to sell them next "to a certain William Mitchell in the hope that the disease with which they were afflicted would be of short duration and that they would recover from its effects." Tayloe confesses, however, that Moses "became in a very short time totally blind and useless" and despite "the care and superintendance of the most eminent phicians about Lynchburg died" and that Rebecka is still "entirely unsound diseasd and of little value." The petitioner points out that Willis assigned his bond to Richard Dobbs, "who has recoverd Judgment thereon ... and is now harrassing your orator with an Execution." Tayloe therefore prays that Willis and Dobbs be enjoined "from all further proceedings on the Judgment aforesaid."

Result: Partially granted; dismissed.
