Abstract

Norry Clark attended a public sale in 1821 where he purchased two slaves, an elderly man named Joe and a man named Jim who was suffering from "the worst species of the venereal disease." He agreed to purchase Jim only after the sellers, the trustees of Nicholas Harrison, promised to "guaranty Jim's health--to have him cured at their expense and if he died from that disease they would sustain the loss." Jim, however, died twelve months after the purchase, during which time he was an expence to Clark "tho' he could occasionally walk about and attend to trifles." Clark refused to pay the entire bond and was sued. He seeks an injunction.

Result: Injunction granted; dissolved.
