James Bullock purchased a slave named Billy from Patteson Scruggs, paying $400 in consideration for what he thought to be "a clear, legal, and absolute title." A few months after the sale, a third party sued Scruggs for the recovery of Billy "under a title paramount and prior in date to that of the said Scruggs." Bullock immediately sought to cancel the contract but Scruggs "wholly refuses to do so." Bullock asks the court to restrain Scruggs from collecting payment on the bond.
Result: Dismissed.
