Abstract

Henry Forqueron purchased a slave named Ned for $350 from the estate of a Mrs. Cobbs; Littleberry Hawkins served as his security in the transaction. When Forqueron decided a short time later to move to Kanawha County, Hawkins objected to him taking Ned with him. Forqueron agreed to leave Ned with Littleberry "as a pledge," and asked a neighbor, Robert Hawkins, to harvest his unfinished tobacco crop, transport it to market, sell it, and pay off his debt. Although Hawkins paid a portion of the debt out of the proceeds from the tobacco, he died before he could provide an account. Forqueron now sues Littleberry Hawkins and the administratrix of the estate of Robert Hawkins, demanding that he be allowed to redeem Ned, that Littleberry Hawkins compensate him for Ned's hire, and that Hawkins's administratrix render an account of the tobacco crop.

Result: Dismissed at request of plaintiff.
