Abstract

John C. Noell purchased a sixteen-year-old slave named Jim for $450 at an estate auction. Prior to the purchase he enquired of Colonel T. Moore, who had previously hired Jim, as to the slave's health. Noell was particularly concerned about a rumor that Jim had received an injury to his hip. Moore informed Noell and "the bystanders" that Jim "was as fine a boy as ever was &c." Noell purchased Jim when he was again "hoisted for Sale to the highest bidder" and took him home to find that Jim was "diseased" and suffered from severe rheumatism in his "hip or hips." Jim, in fact, died before he "half-compensated your orator for his board nurseing &c &c." Asserting that he was "deceived & induced to give a sound price for said boy as though he was sound," Noell seeks an injunction against Anderson's heirs and administrators who have filed suit against him for nonpayment of his bonds.
