Abstract

Being "an improvident manager of his property," Pleasant Talbot was prevailed upon by his friends to put his holdings in a trust managed by his brother, Merritt Talbot, who hired William Morgan as overseer to the slaves and the land. After a disagreement "over the value of the services of the sd. Morgan," the Talbots executed a bond to Morgan worth $42.97. Morgan then traded the bond to petitioner Lewis Merritt, "who transfered to John Roper an interest in the same." Morgan then instituted a suit to collect the debt of the bond "for the benefit of" Roper and Merritt whereby an "execution founded on sd. judgment was levied on the slave Harry (or Henry)." Merritt Talbot has paid Roper his interest in bond "& the same now belongs entirely to your orator, and no part thereof hath been paid of satisfied." Merritt Talbot now "refuses to pay the said Judgment either from the property of the estate, or from the sale of the property, or from his own property." Lewis Merritt prays that the court decree to him "the amount of the Judgment aforesaid from the property conveyed in trust aforesaid, or from the annual profits thereof, or from the sd. Merritt Talbot."
